Lack of provision for spouse provided in a Will

Wife of 20 years left with insufficient provision from her husband's Will, which left most of his estate to his children from a previous marriage

The deceased was torn between leaving provision for his children and his second wife of over 20 years.

Whilst he talked about changing his Will to make things more equal between the two competing parties, he died before he was able to make an appointment to see his solicitor.

The terms of the Will left some financial provision for the second wife but she found herself in a position where she would have to leave the matrimonial home, which had been her home for over 17 years.

    The children of the family were keen to obtain their inheritance as they had their own financial pressures.

An agreement was eventually reached by negotiation which enabled an alternative property to be purchased for our client and sufficient surplus to allow her to live comfortably.
